Updated April 30, 2020 – Carlsbad, CA. In 2018, the Sikh Society of San Diego and its governing board members, represented by Carlsbad attorney Golnar Fozi, prevailed in an declaratory relief and injunctive relief action filed against them by a five individuals who claim the corporate bylaws of the organization were not properly amended in 2005, and that the non-profit religious corporation must dissolve its governing board and revert to bylaws drafted in 1998. After several years of litigation, the Superior Court resolved this matter in favor of the Sikh Society of San Diego and its governing board members.
In April 2020, the California Court of Appeal, Fourth Appellate District, Division One, affirmed the 2018 judgment by the San Diego Superior Court, in favor of the Sikh Society of San Diego and its governing board members. The Court of Appeal agreed with the Superior Court’s finding that the case was barred by the statute of limitations. Therefore, the court refused to unwind all of the corporate actions taken by the board since the 2005 amendments were adopted.
